1. ACCEPTANCE
These Terms & Conditions ("Terms") govern your access to and use of the Jen Beauty mobile application and platform ("Platform") operated by Jen Beauty. By creating an account, booking a service, or making a payment, you agree to be bound by these Terms, our Privacy Policy, Cancellation Policy, and Refund Policy.
If you do not agree, please do not use the Platform.
2. PLATFORM ROLE
Jen Beauty is an intermediary technology platform that facilitates bookings between customers ("Users") and independent beauty/wellness professionals ("Service Providers"). Jen Beauty does not directly employ Service Providers for the purpose of performing services unless explicitly stated. Service Providers are independent contractors responsible for the quality and delivery of services.
3. ELIGIBILITY
You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872. You represent that information provided during registration is accurate and current.
4. ACCOUNT REGISTRATION
You are responsible for maintaining the confidentiality of your account and OTP-verified login. Notify us immediately of any unauthorised use at support@jenbeauty.in.
5. BOOKINGS & SERVICES
(a) Service descriptions, durations, and prices are displayed on the Platform and confirmed at checkout.
(b) You must provide a valid service address within our serviceable areas.
(c) You must ensure a safe, appropriate environment for the Service Provider at the scheduled time.
(d) Additional charges (travel, GST, platform fees) are shown before payment confirmation.
(e) Jen Beauty may assign or reassign Service Providers based on availability.
6. PAYMENTS
(a) Payments are processed through authorised payment gateways (e.g., Razorpay).
(b) Prices are in Indian Rupees (INR) unless stated otherwise.
(c) Wallet credits, referral bonuses, and coupons are subject to separate terms displayed at checkout.
(d) You authorise us to charge the selected payment method for confirmed bookings.
7. USER CONDUCT
You agree not to:
- Provide false information or impersonate others;
- Harass, abuse, or endanger Service Providers;
- Use the Platform for unlawful purposes;
- Attempt to circumvent payments or platform fees;
- Reverse engineer or disrupt the Platform.
We may suspend or terminate accounts for violations.
8. SERVICE PROVIDER CONDUCT
Service Providers are expected to maintain professional standards. Report misconduct via in-app support or support@jenbeauty.in.
9. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
(a) Jen Beauty's liability is limited to the amount paid by you for the specific booking giving rise to the claim.
(b) We are not liable for indirect, incidental, or consequential damages.
(c) We do not guarantee uninterrupted or error-free Platform operation.
(d) Service quality disputes should be reported promptly; remedies may include re-service, partial refund, or wallet credit as per our Refund Policy.
Nothing in these Terms limits liability that cannot be excluded under the Consumer Protection Act, 2019.
10. INDEMNITY
You agree to indemnify Jen Beauty against claims arising from your misuse of the Platform, violation of these Terms, or harm caused to Service Providers due to your conduct.
11. INTELLECTUAL PROPERTY
All Platform content, branding, logos, and software are owned by Jen Beauty or its licensors. You may not copy or distribute without written permission.
12. FORCE MAJEURE
We are not liable for delays or failures due to events beyond reasonable control (natural disasters, government actions, network outages, pandemics, etc.).
13. GOVERNING LAW & DISPUTES
These Terms are governed by the laws of India. Courts at Gurugram, Haryana, India shall have exclusive jurisdiction, subject to your rights under the Consumer Protection Act, 2019 to approach appropriate consumer forums.
14. AMENDMENTS
We may modify these Terms at any time. Updated Terms will be published on the Platform. Material changes may require renewed acceptance.
